1. General conditions
No images or products shall be provided before payment is made in full.
Cameras, including cell phone cameras, and recording devices may not be used during our session.
There is no guarantee of the number of images presented from a session. Many factors contribute to this, including the cooperativeness of the subject.
Images presented to the client are the only images available.
If the subject is a minor I certify that I am legally able to give consent for the minor child.
The parents are present at the photoshoot and are responsible for the safety of their children.
Any damages occurred to the photographer's equipment, props or property due to unsupervised children must be fully compensated by the parents.
Due to the artistic nature of custom photography, all sales are final, no returns will be accepted.
If the client needs to cancel or postpone the session, he/she should inform the photographer at least 48 hr in advance.
3. Copyright and Reproductions
The photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions. The photographer shall only make reproductions for the client. The photographer shall make reproductions for the photographer's portfolio, samples, self-promotions, an entry in photographic contests or art exhibitions, editorial use, or for display within or on the outside of the photographer’s studio only if the client has agreed to this on the contract. If the photographer desires to make other uses, the Photographer shall not do so without first obtaining the written permission of the client.
4. Client’s Usage
The client will receive digital images for personal use only, and shall not sell said prints or publish them online (social media, blog, etc) without the photographer's watermark on them or without mentioning the photographer's name linked to www.bycohen.com or www.facebook.com/lauracohenphoto. The customer may not change the pictures without the photographer's permission.
5. Failure to Perform
If the photographer cannot perform this agreement due to a fire or other casualty, strike or other cause beyond the control of the parties, or due to the photographer’s illness, the photographer will communicate the situation to the customer, if possible, in advance.
The charges in this agreement are based on the current session fee. The session fee is adjusted periodically and future sessions shall be charged at the prices in effect at the time when the session is booked.
7. Additional Costs
Please bear in mind that photo sessions on location or people other than the main subject appearing on the pictures might incur additional costs depending on the package. Once you send the contract, you agree to pay for any additional cost described on the chosen package.
